INTERNET TERMS & CONDITIONS
1. All purchases must be paid in full before _____, ________________,______. Failure to do so will result in legal action. Buyer agrees to pay any and all charges and expenses incurred, including without limitation, reasonable collection and/or attorney fees.
2. Payment shall be in CASH, VISA / MASTER CARD or PAYPAL. Any handling, shipping, and insurance charges are the buyer’s responsibility.
3. Pickup is ONLY ____________________________________________.All items must be removed at this time. (Removal times will be strictly enforced! If you can't remove your purchases in the time given, please do not bid on this auction.)
Smaller items in this auction are available for shipping, please contact us by close of auction to arrange shipping.
Small items that are requested to be shipped will be carried to Parcel Express in Boerne, Texas.
Buyer will be contacted by Parcel Express to arrange for shipping. Buyer will pay Parcel Express directly for all shipping, packing and handling.
Items must be paid for by times designated in item (1) before item will be delivered to shipper.
Once items are delivered to shipper, auctioneer/company is not responsible for any damage or loss.
4. Sales tax will be collected on taxable items at the appropriate sales tax rate unless you have filled out a valid Texas Resale Exemption form with us. You may fax your form to: (830) 537-9111. We must have this on file in order to exclude sales tax from your purchases on your final invoice.
5. TexasBid will try to be as accurate in the description of items and will try to disclose any defects if found or known. TexasBid cannot be held responsible for missed defects or misnomer. All property being displayed for public inspection and shall be sold AS IS, WHERE IS, WITH ALL FAULTS and WITHOUT RECOURSE FOR ANY REFUND OR REDUCTION OF SALE PRICE. Misnomer or incorrect description shall not entitle the purchaser to any refund or reduction of the sales price. This is not a sale by sample or description. All bidders are urged to closely inspect all items offered. ALL SALES ARE FINAL. No Credit Card charge backs will be accepted.
6. It is the bidder’s responsibility to determine description, age, authenticity, count and condition. No warranties or representations, expressed or implied, of any kind are made with respect to merchantability or fitness for a particular purpose of any item in this auction. Once sold there are no refunds of any kind. All descriptions are believed to be accurate, however, all bidding and buying is based solely on bidder's personal inspection and/or opinion of the items.
It is the Bidder/Purchaser’s sole responsibility to:
(a) perform all inspections of the items and to be satisfied as to its description, condition and/or authenticity prior to bidding.
(b) independently verify any information they deem important including information available.
(c) All information contained in the item description and all promotional materials, including, but not limited to, photographs, dimensions, conditions, etc., was provided by or on behalf of the Seller and is believed to be correct; however, neither the Seller nor the Auction Company makes any promise, representation, guarantee, or warranty as to the accuracy or completeness of such information.
(d) Failure to inspect the property does not relieve bidder of responsibility for payment and removal as stated in these terms.
7. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall the Bidder have any claim against TexasBid or anyone else if the Internet service fails to work correctly before or during the auction. TexasBid cannot be responsible for any missed bids.
8. Ten percent buyers premium.
9. TexasBid offers internet bidders a proxy bid service where you bid your maximum amount and the computer will bid for you up to that amount. If you choose to go higher you can. Just place your maximum bid and let the computer bid on your behalf.
10. TexasBid reserves the right to refuse service/use of this site to anyone for any reason.
11. Items subject to additions/deletions prior to close of auction.
12. Bidding on any item indicates acceptance of these terms and conditions.
